Terms of Service for the ImapCopy Service

These Terms of Service (the "Terms") define the conditions for making available and using the ImapCopy Service (the "Service" or "ImapCopy Service").
Together with the documents they reference, they form a contract between LWS - Ligne Web Services SAS, a French company represented by its manager, with a share capital of 500,000 euros, whose registered office is located at 2 rue Jules Ferry 88190 Golbey, registered with the RCS of Epinal under number 851 993 6830 0016 (hereinafter "LWS"), and any natural or legal person, consumer or professional, private or public law, using the Service made available at "imapcopy.lws.fr" (hereinafter the "User" or "You"); the User and LWS being individually or jointly referred to as the "Party(ies)".
Article I: SERVICE DESCRIPTION
As part of the ImapCopy Service, LWS provides Users with a tool accessible via the Internet at "https://imapcopy.lws.fr" allowing the copying of mailbox contents.
The Service copies emails contained in a source mailbox to a destination mailbox. The different compatible mailbox types are specified in the documentation available in the LWS knowledge base at "https://aide.lws.fr".
The Service is provided "as is" and "as available", without any express or implied warranty, including but not limited to performance, fitness for a particular purpose, reliability, continuity or absence of errors.
The ImapCopy Service is offered free of charge, without any service level agreement (SLA), and without any guarantee of availability or continuity.
Article II: ACCESS AND AVAILABILITY OF THE SERVICE
The Service is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond LWS's control, and subject to possible outages or maintenance required for proper operation of the Service and equipment.
LWS does not guarantee that the Service will be free from anomalies, errors, or bugs, nor that they can be corrected. LWS does not guarantee compatibility with all browsers or operating systems.
LWS reserves the right to modify, suspend, or stop the Service, temporarily or permanently, in whole or in part, at any time and without notice. LWS cannot be held liable for the consequences of such changes, suspensions, or stoppages for the User.
Article III: USER OBLIGATIONS

The User undertakes to use the Service in accordance with these Terms and applicable laws.

The User is solely responsible for their use of the Service and the information they copy via the Service.

The User undertakes not to use the Service for unlawful, fraudulent, or malicious purposes.

The User undertakes not to infringe third-party rights or public order when using the Service.

The User undertakes not to use the Service in a way that disrupts its operation or undermines the integrity of the Service or LWS systems.

The User is solely responsible for the accuracy, legitimacy and use of the credentials, passwords and mailbox access provided through the Service. LWS performs no verification of ownership or legitimacy of the source or destination mailboxes.

The User agrees to indemnify and hold LWS harmless against any claim, action, judgment, damage, cost or demand arising directly or indirectly from the use of the Service, a breach of these Terms or applicable law.

The User assumes all risks related to the use of the Service.
Article IV: LIMITATION OF LIABILITY
LWS uses reasonable means to ensure quality access to the Service but is not subject to any obligation of result.
LWS cannot be held liable for direct or indirect, material or immaterial damages resulting from the use or inability to use the Service.
LWS cannot be held liable for damages resulting from a fraudulent intrusion by a third party leading to a modification of information made available via the Service.
In any event, LWS's liability, in case of breach of its obligations, can only be engaged for direct and proven damages caused to the User, excluding any indirect, immaterial, foreseeable, or unforeseeable damage.
LWS shall never be held liable for the loss, alteration, deletion, duplication or corruption of emails, data or content during the use of the Service, including in case of user error, Service malfunction or a failure on third-party servers.
The User assumes all risks related to the use of the Service.
In no event shall LWS's total financial liability, for all causes combined, exceed the symbolic sum of one (1) euro or, where applicable, the amount actually paid by the User for the use of the Service.
Article V: PRIVACY POLICY AND DATA RETENTION
5.1 Data Collected

IMAP servers of the source and destination mailboxes.

Email addresses of the source and destination mailboxes.

Passwords of the source and destination mailboxes (transmitted in encrypted form and used only for the duration of the copy).

User IP address.

The ImapCopy Service does not collect the User's name, surname, postal address, or phone number.
5.2 Data Processing

Personal information collected is processed solely to ensure the proper operation of the Service, namely copying emails from a source mailbox to a destination mailbox.

Copied emails are not retained on the ImapCopy Service servers. They pass directly from the source mailbox to the destination mailbox, without permanent intermediate storage on our infrastructure.
5.3 Data Retention

Personal information mentioned in Article 5.1 (email addresses, passwords of copied mailboxes, IP address) is retained by LWS for a maximum of three hundred sixty-five (365) days from the end of the copy or the User's last use of the Service. After this period, the data is permanently deleted.

Mailbox passwords are used temporarily for the copy operation and are not stored permanently. They are deleted seventy-two (72) hours after the end of the copy operation.

Data is retained only when strictly necessary for security, traceability, abuse prevention or to comply with legal or regulatory obligations.
5.4 User Rights

In accordance with the GDPR and French Data Protection Law, the User has the right of access, rectification, erasure, restriction of processing, objection, and data portability. The User may exercise these rights by contacting LWS at rgpd@lws.fr. The User also has the right to lodge a complaint with the CNIL (French Data Protection Authority) if they believe their rights have not been respected.
5.5 Data Security

LWS implements all appropriate technical and organizational measures to ensure the security and confidentiality of personal data collected, in particular to prevent their alteration, destruction, or access by unauthorized third parties.

However, the User acknowledges that the email addresses of the source and destination mailboxes, as well as their associated passwords, are transmitted to the source and destination mail servers via the IMAP protocol.

LWS has no control over the retention or use policies of these mail servers. It is up to the providers of these services to define whether such information is stored temporarily or permanently and how it is used.

The User is invited to consult the privacy policies of their email service providers to understand their data management practices.
Article VI: JURISDICTION AND APPLICABLE LAW
6.1. Jurisdiction
In the event of a dispute with a client not considered a Consumer within the meaning of the French Consumer Code, express jurisdiction is granted to the Commercial Court of Epinal (France), notwithstanding multiple defendants or warranty claims, including for urgent measures, interim relief, or ex parte proceedings.
6.2. Applicable Law
This contract is governed by French law, both for substantive and procedural rules, to the exclusion, on the one hand, of the conflict-of-law rules provided by French law, and on the other hand, of French law provisions that would be contrary to these Terms. The client undertakes to comply with French and international laws in force when using the Service.
